Service Description

hapsay is a platform that helps businesses manage customer conversations and bookings on Facebook Messenger and Instagram. The platform processes incoming messages, responds to customer inquiries, and creates booking records on behalf of connected businesses.

Account Terms

Business accounts are created and managed by authorized staff members. By creating an account, you agree that:

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You will provide accurate and complete information during registration and keep it up to date.
  • You must be at least 18 years old to create a business account.

Acceptable Use

You agree not to:

  • Abuse, manipulate, or attempt to exploit the automated messaging system.
  • Use the platform for any illegal activity or to facilitate illegal transactions.
  • Send spam, unsolicited messages, or bulk communications through the messaging channels.
  • Attempt to access data belonging to other businesses on the platform.
  • Reverse-engineer, decompile, or disassemble any part of the service.

Customer Data

Businesses retain ownership of their customer data. hapsay processes customer data solely on behalf of the business to provide the service. This includes:

  • Storing booking information and customer contact details.
  • Processing conversation messages to generate automated responses.
  • Sending notifications and reminders on the business’s behalf.

Businesses are responsible for ensuring they have appropriate consent from their customers to collect and process their data through the platform.

Automated Features

The automated messaging system is designed to help customers with bookings, availability inquiries, and general questions. Please note:

  • Automated responses are assistive in nature and may occasionally be inaccurate.
  • Businesses are responsible for verifying the accuracy of booking information created through the platform.
  • The system operates within the parameters configured by the business — it can only access information and perform actions that the business has enabled.
  • When the automated system cannot resolve a request, the conversation is routed to a staff member for manual handling.

Meta Platform Compliance

hapsayconnects to Facebook Messenger and Instagram through Meta’s platform APIs. By using the service, businesses agree to:

  • Comply with Meta Platform Terms and Messenger Platform Policy.
  • Only use the messaging channels for legitimate business communication with customers who have initiated contact.
  • Not use the platform to send advertising, spam, or unsolicited messages.

hapsay is not responsible for actions taken by Meta against business accounts for policy violations.

Availability and Support

We strive to maintain high availability of the service but do not guarantee uninterrupted access. The platform is provided on a best-effort basis:

  • Scheduled maintenance will be communicated in advance when possible.
  • We do not currently offer a formal Service Level Agreement (SLA).
  • Support is available via email at [email protected].

Intellectual Property

The hapsay platform, including its software, design, and documentation, is the intellectual property of hapsay.

  • Businesses retain full ownership of their content, data, and branding.
  • Businesses grant hapsay a limited license to use their content solely for the purpose of providing the service.
  • Neither party may use the other’s trademarks without prior written consent.

Limitation of Liability

To the maximum extent permitted by law, hapsay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from the use of the service.

Our total liability for any claim related to the service shall not exceed the amount paid by the business for the service in the twelve (12) months preceding the claim.

Termination

Either party may terminate the service relationship:

  • Businesses may request account termination at any time by contacting us.
  • hapsay may terminate accounts that violate these terms, with reasonable notice when possible.
  • Upon termination, businesses may request an export of their data within 30 days.
  • After 30 days, all business data will be permanently deleted from our systems.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of the Philippines.
